Consent*I hereby agree and acknowledge that, in partial consideration for the commitments and obligations agreed to by Mountain Town Stages, a Utah nonprofit corporation d/b/a Mountain Town Music and its employees, agents, representatives and affiliates (collectively, “MTM”) in connection with the Door 2 Door Event (the “Event”) booked to be held on the date agreed upon by MTM and myself, I shall indemnify, defend and hold MTM harmless from any claims arising out of, including, without limitation: (i) any civil claims brought by any homeowners association, homeowner or other party brought against MTM for violations of nuisance and noise ordinance laws; (ii) any criminal claims brought against MTM for violations of nuisance and noise ordinance laws; (iii) any personal injury claims brought against MTM by me or any third party in connection with the Event; and (iv) any other claims for compensation or damages arising out of the Event in any shape or form. I also hereby agree and acknowledge that MTM has agreed to perform services in connection with the Event based on my procurement of consent and approval of all homeowners and occupants in proximity to the Event, and, if applicable, any homeowners’ association with jurisdiction over the property on which the Event is to be held. I agree to the terms of service.Refunds*All payments made to MTM in consideration for the Event shall become non-refundable if I do not cancel the Event at least seven (7) calendar days prior to the date of the Event. Should inclement weather or government action require postponement of the Event during the seven-day period prior to the Event, the non-refundable payments made to MTM shall be applied to the postponed Event, but shall not be refunded to me.
